GENERAL TERMS AND CONDITIONS OF SALE<\/h3>\n\n\n\n

These General Terms and Conditions of Sale govern the commercial activity of EYAKLA SAS, with a share capital of 1,000 euros, whose registered office is located at 60 rue Fran\u00e7ois 1er – 75008 PARIS, registered with the Paris Trade and Companies Register (RCS) under number 981 195 555 00017, email: service[at]ohselection(point)com<\/p>\n\n\n\n

ARTICLE 1. SCOPE AND AMENDMENT OF THE GENERAL TERMS AND CONDITIONS OF SALE <\/strong><\/h6>\n\n\n\n

In accordance with Article L. 441-1 of the French Commercial Code, these general terms and conditions of sale (GTC) constitute the sole basis of the commercial relationship between the parties and apply to all orders placed on the website: www.ohselection.com<\/p>\n\n\n\n

The publisher reserves the right to adapt or amend these general terms and conditions of sale at any time.In the event of an amendment, the general terms and conditions of sale in force on the day of the order will apply to each order.<\/p>\n\n\n\n

These general terms and conditions of sale exclusively concern non-commercial natural persons.<\/p>\n\n\n\n

ARTICLE 2. PRICES <\/strong><\/h6>\n\n\n\n

The prices of our products are indicated in euros or in another currency if offered on the website, all taxes included (VAT + other taxes) excluding participation in processing and shipping costs. The prices of our products are public prices. In the event of an order to a country other than metropolitan France, any customs duties or local taxes will be borne by the recipient. OH Selection reserves the right to modify prices at any time, but undertakes to apply the rates in force displayed at the time of your order, subject to availability on that date. Products remain the property of OH Selection until full payment of the price is received by OH Selection. Payment is made before product delivery. <\/p>\n\n\n\n

ARTICLE 3. PRODUCT AVAILABILITY <\/strong><\/h6>\n\n\n\n

Our product and price offers are valid as long as they are visible on the site. Upon receipt of your order, we verify the availability of the product(s) ordered. In case of unavailability, we undertake, within 30 days from the order validation, either to deliver the ordered product within the limits of available stock or to refund you by re-crediting your bank card. <\/p>\n\n\n\n

The order registration date corresponds to the date of payment by online bank card using our partner’s secure payment terminal.<\/p>\n\n\n\n

In the event of a stockout for one of the products in your order, we will ship the rest of your order, accompanied by an information message on the packing slip.<\/p>\n\n\n\n

ARTICLE 4. ORDER VALIDATION AND ELECTRONIC SIGNATURE (LAW OF MARCH 13, 2000 ON ELECTRONIC SIGNATURES) <\/strong><\/h6>\n\n\n\n

Any order validated by clicking the validation button implies irrevocable acceptance of these general terms and conditions of sale.<\/p>\n\n\n\n

The “double click” associated with the authentication and non-repudiation procedure and the protection of message integrity constitutes an electronic signature.<\/p>\n\n\n\n

This electronic signature has the same value between the parties as a handwritten signature.<\/p>\n\n\n\n

ARTICLE 5. PAYMENT METHODS AND SECURITY <\/strong><\/h6>\n\n\n\n

Payment for your purchases is made in cash.<\/p>\n\n\n\n

Cash payment by credit card<\/em><\/strong><\/p>\n\n\n\n

You can pay by credit card: in this case, payment is processed by our secure payment partner WooPayments (Stripe infrastructure). This means that no banking information concerning you transits via the OH Selection website. Payment by credit card is therefore perfectly secure. Your order will be registered as soon as payment is accepted by the banking service. You can pay online with confidence by entering your credit card number, expiration date, and the security code on the back of the card in the designated fields. <\/p>\n\n\n\n

Your credit card details are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment is made directly to the bank. OH Selection never has access to these details and does not store them on its servers. This is why they are requested again for each new transaction on our site. In accordance with European regulations (DSP2), your bank may request strong authentication (3D Secure) during payment. <\/p>\n\n\n\n\n\n\n\n

Cash payment via PayPal<\/em><\/strong><\/p>\n\n\n\n

You can pay via the PayPal system for all orders.<\/p>

Payment by Apple Pay and Google Pay<\/strong><\/p>

You can also pay for your purchases using Apple Pay or Google Pay from a compatible device.<\/p>\n\n\n\n

ARTICLE 6. DELIVERY METHODS <\/strong><\/h6>\n\n\n\n

6.1 Order preparation times<\/strong><\/p>\n\n\n\n

All OH Selection products, with few exceptions, being in our warehouses, your orders are prepared and shipped within 48 to 72 business hours after receipt of your credit card payment.<\/p>\n\n\n\n

Orders placed on a Saturday, Sunday, or public holiday will be processed on the next business day.The ordered product is delivered to the address provided on the order form. In case of an input error, particularly an incorrect or incomplete delivery address, OH Selection cannot be held responsible for the consequences in terms of delay or inability to deliver. All costs related to the reshipment of products due to a customer input error will be borne exclusively by the customer. <\/p>\n\n\n\n

The customer is informed that OH Selection reserves the right to choose the most suitable mode of transport depending on the nature of the product, its weight, and its volume. Delivery times cannot be guaranteed in cases of force majeure, particularly in the event of strikes or disruptions related to road transport, as defined by case law. Delivery times do not take into account any potential payment verification procedures that would delay the shipment of the order. <\/p>\n\n\n\n

Delivery times may not exceed 30 business days after the payment validation date by the Customer.The announced times are ex-warehouse times.<\/p>\n\n\n\n

OH Selection cannot be held responsible for delivery delays due to customer unavailability.<\/p>\n\n\n\n

Services will be performed at OH Selection or at another location indicated in the catalog. All details will be communicated to the customer. <\/p>\n\n\n\n

6.2 Delivery tracking<\/strong><\/p>\n\n\n\n

After payment validation, an order number is assigned to you. Your order is then registered. We advise you to print and keep the order number. You can track the progress of your order at any time within your customer area “My Account”. <\/p>\n\n\n\n

The Customer must provide a valid email address, failing which OH Selection cannot be held responsible for the resulting consequences. The customer must ensure that their data is updated in their Customer area. <\/p>\n\n\n\n

6.3 For product shipments by a carrier<\/strong><\/p>\n\n\n\n

Delivery is made at the foot of the building and not to the floor or inside the house.<\/p>\n\n\n\n

6.4 Delivery rates<\/strong><\/p>\n\n\n\n

The customer is informed that they are billed proportionally to the weight and volume of the products purchased. The contribution to shipping costs includes, in particular, packaging and carrier shipping fees. <\/p>\n\n\n\n

The amount of fees is automatically calculated as soon as a product is added to the cart, based on delivery in Metropolitan France. The customer can freely consult the billing and the carrier associated with their products.The final calculation of shipping costs for other destinations (abroad) is made once the delivery country is entered in the delivery address. <\/p>\n\n\n\n

6.5 Countries delivered<\/strong><\/p>\n\n\n\n

We deliver to France (including overseas departments and territories), Europe, the United Kingdom, Switzerland, and the rest of the world, except in specific cases. Available delivery methods and rates are displayed in the cart based on the delivery country. <\/p>\n\n\n\n

ARTICLE 7. RESPONSIBILITIES <\/strong><\/h6>\n\n\n\n

OH Selection cannot be held responsible for the non-performance of the contract concluded in case of unforeseen circumstances and force majeure as defined by law and jurisprudence.<\/p>\n\n\n\n

The choice and purchase of a product are under the sole responsibility of the customer.<\/p>\n\n\n\n

Eyakla company has, for all stages of website access and order processing, only an obligation of means. Eyakla \/ OH Selection’s liability cannot be engaged for any inconveniences or damages inherent to the use of the internet network, including service interruption, external intrusion, or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law. <\/p>\n\n\n\n

ARTICLE 8. RIGHT OF WITHDRAWAL <\/strong><\/h6>\n\n\n\n

In accordance with the provisions of Article L. 221-18 of the French Consumer Code, the customer has a period of 15 days to exercise their right of withdrawal. The starting point of this period is the day of receipt of the last ordered product, by the customer or a third party expressly designated by them. If this period normally expires on a Saturday, Sunday, or public holiday, it is extended until the next business day. <\/p>\n\n\n\n

To exercise their right of withdrawal, the customer may return the product(s) concerned in their original packaging, complete (accessories, manual, etc.) in perfect condition after contacting service[at]ohselection(point)com within 15 days of receipt of the last item, with the postmark serving as proof. To expedite the processing of your return, OH Selection kindly requests the customer to include the invoice and a free-form note indicating the order number and their wish to exercise their right of withdrawal. Incomplete, damaged, or soiled items returned by the customer will not be accepted. The refund will be deferred until receipt of the goods. <\/p>\n\n\n\n

In the event of exercising the right of withdrawal within the aforementioned period, OH Selection will reimburse the customer the price of the purchased product(s) as well as the initial delivery costs (based on the least expensive standard delivery method); return costs are covered by OH Selection.<\/p>\n\n\n\n

For all products manufactured according to the customer’s own specifications (e.g., engraving, personalization), the customer cannot exercise their right of withdrawal.<\/p>\n\n\n\n

ARTICLE 9. RETURN AND REFUND <\/strong><\/h6>\n\n\n\n

9.1 Time limit for returning an item<\/strong><\/p>\n\n\n\n

The customer has a period of 14 days from the communication of their decision to withdraw to return the item(s) that do not suit them (Article L. 221-23 of the French Consumer Code), subject to compliance with the conditions set out below.<\/p>\n\n\n\n

9.2 Return condition<\/strong><\/p>\n\n\n\n

Except for defective products, all returned products (watches, cufflinks, watch winders, etc.) must be new and in their original, intact packaging, without any writing.<\/p>\n\n\n\n

No return will be accepted and therefore no refund will be issued if the returned products have been visibly damaged by the customer and such damage renders the product unfit for sale.<\/p>\n\n\n\n

9.3 Return and refund procedures<\/strong><\/p>\n\n\n\n

In case of a simple return (including withdrawal):<\/em><\/strong><\/p>\n\n\n\n

For proper receipt and to expedite the processing of your return, please send your request by email to service[at]ohselection(point)com or via the contact page form.<\/p>\n\n\n\n

OH Selection will then have a period of 14 days from the receipt of your decision to withdraw to proceed with the refund, using the same payment method.<\/p>\n\n\n\n

OH Selection will also have the option to defer the refund until receipt of the product.In all cases, for the return of one or more items subject to a promotional offer or sale, the refund amount will be that indicated on the invoice attached to the package.<\/p>\n\n\n\n

In case of return of a defective product:<\/em><\/strong><\/p>\n\n\n\n

The customer can return a defective product to OH Selection by contacting service[at]ohselection(point)com.<\/p>\n\n\n\n

Prior to this return, the Customer must contact OH Selection via the contact form on the website.In the event of a defective product return, after OH Selection has confirmed the product’s defect, OH Selection will refund the customer the price of the item(s) concerned, excluding shipping costs and return costs.Any other product defect will be covered by the commercial warranty and\/or by the legal warranty, as specified in Article 10 below.<\/p>\n\n\n\n

ARTICLE 10. WARRANTIES AND AFTER-SALES SERVICE <\/strong><\/h6>\n\n\n\n

In the event of non-conformity or defect of the delivered product, the customer must inform OH Selection’s Customer Service, which undertakes to remedy the problem as soon as possible. This includes directing the customer to the correct After–<\/strong>Sales Service, depending on the nature of the product and the supplier. <\/p>\n\n\n\n

Any warranties granted by the manufacturer will be available from OH Selection upon request.<\/p>\n\n\n\n

To claim the commercial warranty, it is the customer’s responsibility to contact the manufacturer’s customer service directly as specified on the product sheet. The customer can also request any information from OH Selection. <\/p>\n\n\n\n

To benefit from the commercial warranty, it is imperative to keep the product’s purchase invoice as well as all product accessories.<\/p>\n\n\n\n

Warranty exclusions will be indicated by the manufacturer.<\/p>\n\n\n\n

In any event, you may sometimes benefit from the manufacturer’s commercial warranty, but also from the legal guarantees of conformity of the goods to the contract and hidden defects in accordance with legal provisions. The provisions of this article do not prevent you from benefiting from the right of withdrawal. <\/p>\n\n\n\n

ARTICLE 11. INTELLECTUAL PROPERTY <\/strong><\/h6>\n\n\n\n

All elements of the OH Selection website, whether visual or audio, are protected by copyright, trademarks, or patents. They are the exclusive property of Eyakla, the publisher of OH Selection. As such, and in accordance with the provisions of the Intellectual Property Code, only private use is authorized, subject to different or more restrictive provisions of the intellectual property code. <\/p>\n\n\n\n

Any total or partial reproduction of the OH Selection website is strictly prohibited without prior agreement.<\/p>\n\n\n\n

ARTICLE 12. ENTIRETY <\/strong><\/h6>\n\n\n\n

In the event that one of the clauses of this contract is null and void due to a change in legislation, regulation, or a court decision, this shall in no way affect the validity and observance of these general terms and conditions of sale.<\/p>\n\n\n\n

ARTICLE 13. DURATION <\/strong><\/h6>\n\n\n\n

These conditions apply for the entire duration of the online availability of services offered by Eyakla company.<\/p>\n\n\n\n

ARTICLE 14. PROOF <\/strong><\/h6>\n\n\n\n

Computerized records, kept in the computer systems of Eyakla company, publisher of OH Selection, and its partners under reasonable security conditions, will be considered as proof of communications, orders, and payments between the parties.<\/p>\n\n\n\n

ARTICLE 15. RETENTION AND ARCHIVING OF TRANSACTIONS <\/strong><\/h6>\n\n\n\n

Order forms and invoices are archived on a reliable and durable medium to correspond to a faithful and durable copy in accordance with Article 1379 of the Civil Code.<\/p>\n\n\n\n

ARTICLE 16. DISPUTES <\/strong><\/h6>\n\n\n\n

These conditions are subject to French law.<\/p>\n\n\n\n

In case of dispute, OH Selection and the customer will attempt to resolve it. In case of failure of the transaction, only French courts will have jurisdiction. <\/p>\n\n\n\n
