GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern the commercial activity of EYAKLA SAS, with a capital of 1,000 euros, whose registered office is located at 60 rue François 1er – 75008 PARIS, registered with the PARIS Trade and Companies Register under number 981 195 555 00017, email: service[at]ohselection(point)com

ARTICLE 1. SCOPE OF APPLICATION AND AMENDMENT OF THE GENERAL TERMS AND CONDITIONS OF SALE

In accordance with Article L 441-6 of the Commercial Code, these general terms and conditions of sale (GTC) form the sole basis of the commercial relationship between the parties and apply to all orders placed on the website: www.ohselection.com

The publisher reserves the right to adapt or modify these general terms and conditions of sale at any time.
In the event of modification, the general terms and conditions of sale in force on the day of the order will apply to each order.

These general terms and conditions of sale exclusively concern non-commercial natural persons.

ARTICLE 2. PRICES

The prices of our products are indicated in euros or in another currency if offered on the website, all taxes included (VAT + other taxes) excluding participation in processing and shipping costs. The prices of our products are public prices. In the event of an order to a country other than metropolitan France, any customs duties or local taxes will be borne by the recipient. OH Sélection reserves the right to modify prices at any time, but undertakes to apply the rates in force displayed at the time of your order, subject to availability on that date. Products remain the property of OH Sélection until full payment of the price by OH Sélection. Payment is made before product delivery.

ARTICLE 3. PRODUCT AVAILABILITY

Our product and price offers are valid as long as they are visible on the site. Upon receipt of your order, we verify the availability of the product(s) ordered. In case of unavailability, we undertake, within 30 days from the validation of the order, either to deliver the ordered product within the limits of available stock or to refund you by crediting your bank card.

The order registration date corresponds to the date of online payment by bank card using our partner’s secure payment terminal.

In the event of a stockout for one of the products in your order, we will ship the rest of your order, accompanied by an information message on the packing slip.

ARTICLE 4. ORDER VALIDATION AND ELECTRONIC SIGNATURE (LAW OF MARCH 13, 2000 ON ELECTRONIC SIGNATURE)

Any order validated by clicking the validation button implies irrevocable acceptance of these general terms and conditions of sale.

The “double click” associated with the authentication and non-repudiation procedure and the protection of message integrity constitutes an electronic signature.

This electronic signature has the same value between the parties as a handwritten signature.

ARTICLE 5. PAYMENT METHODS AND SECURITY

Payment for your purchases is made in full.

Upfront payment by bank card

You can make payment by bank card: in this case, payment is made on our partner’s website. This means that no banking information concerning you is transmitted via the OH Sélection website. Payment by bank card is therefore perfectly secure. Your order will thus be registered upon acceptance of payment by the banking service. You can pay online with complete confidence by entering your bank card number, expiration date, and the security code found on the back of the card in the designated fields.

Your credit card details are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment is made directly to the bank. OH Sélection never has access to these details and does not store them on its servers. This is why they are requested again for each new transaction on our site. For security reasons, we activate the 3D-Secure system for all orders over 100 euros.

Payment in 3 or 4 installments by card, without fees, is a service reserved for individuals residing in metropolitan France, allowing you to make a payment in three or four installments and acquire your item from the first payment; and this without any surcharge or interest.

Upfront payment by Paypal

You can make payment via the Paypal system for all orders.

ARTICLE 6. DELIVERY METHODS

6.1 Order Preparation Times

All OH Sélection products, with few exceptions, being in our warehouses, your orders are prepared within 72 business hours after receipt of your bank card payment.

Orders placed on a Saturday, Sunday, or public holiday will be processed on the next business day.
The ordered product is delivered to the address specified on the order form. In case of an input error, particularly an incorrect or incomplete delivery address, OH Sélection cannot be held responsible for the consequences in terms of delay or inability to deliver. All costs related to the reshipment of products due to a customer input error will be borne exclusively by the customer.

The customer is informed that OH Sélection reserves the right to choose the most suitable mode of transport depending on the nature of the product, its weight, and its volume. Delivery times cannot be guaranteed in cases of force majeure, particularly in the event of strikes or disruptions related to road transport, as defined by case law. Delivery times do not take into account any customer payment verification procedures that would delay the shipment of their order.

Delivery times will not exceed 30 business days after the payment validation date by the Client.
The announced times are ex-warehouse times.

OH Sélection cannot be held responsible for delivery delays due to customer unavailability.

Services will be performed at OH Sélection or at another location indicated in the catalog. All details will be communicated to the customer.

6.2 Delivery Tracking

After payment validation, an order number is assigned to you. Your order is then registered. We advise you to print the order number and keep it. You can track its processing steps at any time within your customer area “My Account”.

The Client must provide a valid email address, failing which OH Sélection cannot be held responsible for the resulting consequences. The client must ensure their data is updated in their Client area.

6.3 For product shipments by a carrier

Delivery is made at the building’s entrance, not upstairs or inside the house.

6.4 Delivery Rates

The customer is informed that they are billed proportionally to the weight and volume of the purchased products. Participation in shipping costs notably includes packaging and carrier shipping fees.

The amount of fees is automatically calculated upon adding a product to the cart, based on delivery in Metropolitan France. The customer can freely consult the billing and the carrier associated with their products.
The final calculation of shipping costs for other destinations (abroad) is made once the delivery country is entered in the delivery address.

6.5 Countries Shipped To

Currently, we deliver to Metropolitan France and the rest of the world, except in specific cases.

ARTICLE 7. LIABILITIES

OH Selection cannot be held responsible for the non-performance of the concluded contract in cases of unforeseen circumstances and force majeure as defined by law and case law.

The choice and purchase of a product are under the sole responsibility of the customer.

Eyakla company has, for all stages of site access and order processing, only an obligation of means. Eyakla / OH Selection cannot be held liable for any inconveniences or damages inherent in the use of the internet network, including service interruption, external intrusion, or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.

ARTICLE 8. RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L.121-21 of the Consumer Code, the customer has a period of 14 days to exercise their right of withdrawal. The starting point of this period is the day of receipt of the last product ordered, by the customer or a third party expressly designated by them. If this period normally expires on a Saturday, Sunday, or public holiday, it is extended until the next business day.

To exercise their right of withdrawal, the customer may return the product(s) concerned in their original packaging, complete (accessories, instructions, etc.) and in perfect condition, after contacting service[at]ohselection(point)com within 14 days from the receipt of the last item, with the postmark serving as proof. To expedite the processing of your return, OH Selection kindly asks the customer to include the invoice and a free-form note indicating the order number and their intention to exercise their right of withdrawal with the package. Items returned incomplete, damaged, or soiled by the customer will not be accepted. The refund will be deferred until receipt of the goods.

In the event of exercising the right of withdrawal within the aforementioned period, OH Selection will refund the customer the price of the purchased product(s) excluding shipping costs; return costs are borne by the customer.

For all products made according to their own specifications (e.g., engraving, personalization…), the customer cannot exercise their right of withdrawal.

ARTICLE 9. RETURNS AND REFUNDS

9.1 Time Limit for Returning an Item

The customer has a period of 14 days from the end of the withdrawal period indicated in Article 8 to return any unsuitable item(s), subject to compliance with the conditions set out below.

9.2 Return Conditions

Except for defective products, all returned products (watches, cufflinks, watch winders, etc.) must be new, in their original, intact packaging, and without any writing.

No return will be accepted, and therefore no refund will be issued, if the returned products have been visibly damaged by the customer and such damage renders the product unfit for sale.

9.3 Return and Refund Procedures

In case of a simple return (including withdrawal):

For proper receipt and to expedite the processing of your return, please ensure you send your request by email via the return form available on the website.

OH Selection will then have a period of 14 days, from the receipt of your decision to withdraw, to proceed with the refund, using the same payment method.

OH Selection will also have the option to defer the refund until receipt of the product.
In all cases, if one or more items subject to a promotional offer or sale are returned, the refund amount will be that indicated on the invoice enclosed with the package.

In case of return of a defective product:

The customer can return a defective product to OH Selection by contacting service[at]ohselection(point)com.

Prior to this return, the Client must contact OH Selection via the contact form on the website.
In the event of a defective product return, after OH Selection has confirmed the product’s defect, OH Selection will refund the customer the price of the item(s) concerned, excluding shipping and return costs.
Any other product defect will be covered by the commercial warranty and/or the legal warranty, as specified in Article 10 below.

ARTICLE 10. WARRANTIES AND AFTER-SALES SERVICE

In case of non-conformity or defect of the delivered product, the customer must inform OH Selection’s Customer Service, which undertakes to remedy the problem as soon as possible. Notably by directing the customer to the appropriate AfterSales Service, depending on the nature of the product and the supplier.

Any warranties granted by the manufacturer will be available from OH Selection upon simple request.

To invoke the commercial warranty, it is up to the customer to contact the manufacturer’s consumer service directly as specified on the product sheet. The customer may also request any information from OH Selection.

To benefit from the commercial warranty, it is imperative to keep the product purchase invoice as well as all product accessories.

Warranty exclusions will be indicated by the manufacturer.

In any event, you sometimes benefit from the manufacturer’s commercial warranty, but also from the legal guarantees of conformity of the goods to the contract and hidden defects in accordance with legal provisions. The provisions of this article do not prevent you from benefiting from the right of withdrawal.

ARTICLE 11. INTELLECTUAL PROPERTY

All elements of the OH Selection website, whether visual or auditory, are protected by copyright, trademarks, or patents. They are the exclusive property of Eyakla company, publisher of Eyakla. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to different, or even more restrictive, provisions of the intellectual property code.

Any total or partial reproduction of the OH Selection website is strictly prohibited without prior agreement.

ARTICLE 12. SEVERABILITY

In the event that one of the clauses of this contract is rendered null and void by a change in legislation, regulation, or by a court decision, this shall in no way affect the validity and observance of these general terms and conditions of sale.

ARTICLE 13. DURATION

These conditions apply for the entire duration of the online availability of services offered by Eyakla company.

ARTICLE 14. EVIDENCE

The computerized records, kept in the IT systems of Eyakla company, publisher of OH Selection, and its partners under reasonable security conditions, will be considered as evidence of communications, orders, and payments between the parties.

ARTICLE 15. RETENTION AND ARCHIVING OF TRANSACTIONS

The archiving of purchase orders and invoices is carried out on a reliable and durable medium to constitute a faithful and durable copy in accordance with Article 1348 of the Civil Code.

ARTICLE 16. DISPUTES

These conditions are subject to French law.

In case of a dispute, OH Selection and the customer will attempt to resolve it. Should the amicable settlement fail, only French courts will have jurisdiction.
